Terms & Conditions
By working with NO HANDS DESIGN you agree to the following terms and conditions. These terms may be subject to change at any time.
AGREED HOURLY RATE – The agreed hourly rate for work carried out during the normal business hours (Monday - Friday AEST) is set at $100 +GST per hour. Any short-notice tasks that require an unusually fast turnaround that require NO HANDS DESIGN to make changes to the existing schedule of work will be charged at a rate of $140 +GST per hour to accommodate shuffling of projects. The agreed hourly rate is to remain confidential between The Client and NO HANDS DESIGN. NO HANDS DESIGN reserves the right to change this rate periodically. The current rate will always be available via this page and if a change is made, The Client will be notified by email.
AGREED PROJECT RATE – For work that is quoted in advance, the agreed project rate will be billed exactly as quoted unless there are revision, changes and additions outside the scope of work outlined in the quote. Additional work will be charged at the hourly rate unless otherwise agreed upon between NO HANDS DESIGN and The Client.
SCOPE - The proposed fee refers to a specific scope of work outlined in the proposal document. Any additional requests made outside this scope of work will be charged separately.
PAYMENT – NO HANDS DESIGN invoices ongoing hourly rate work monthly at the start of each month. Quoted project work is invoiced 50% prior to startup and 50% upon completion. Work will not commence until the 50% startup invoice payment has been made. Some clients with tenure with NO HANDS DESIGN may be exempt from the upfront charge. Some projects may require a different % value to be paid upfront. This is at the discretion of NO HANDS DESIGN and will be made clear prior to The Client prior to commencement of work. Payment by The Client is required within 7 (seven) days of receipt of invoice from NO HANDS DESIGN. NO HANDS DESIGN accepts payment by direct deposit and the bank account details will be made available to you when the invoice is sent. Overdue invoices may incur a late payment fee of 10% initially, and an additional fee of 5% for every week it is overdue.
CONFIDENTIALITY – NO HANDS DESIGN agrees not to misuse or disclose any confidential information that may be made available by The Client.
ARTWORK APPROVAL, ERRORS AND OMISSIONS – NO HANDS DESIGN will take all reasonable care to check proofs carefully for accuracy in all respects, ranging from spelling to technical illustrations. However, it is the responsibility of The Client to check all copy, artwork, written material and information carefully before final sign off and publishing or printing. As a result, NO HANDS DESIGN is not liable for loss, expense or damage caused by any act or omission.
NATURE OF COPY – The Client agrees to exercise due diligence in its direction to NO HANDS DESIGN regarding preparation of materials and must be able to substantiate all claims and representations. The Client is responsible for all trademark, service mark, copyright and patent infringement clearances. The Client is also responsible for arranging, prior to publication, any necessary legal clearance of materials NO HANDS DESIGN prepares. NO HANDS DESIGN will not be held liable for any legal infringements as a result of artwork being distributed or published under the direction of The Client.
LIABILITY – NO HANDS DESIGN makes every effort to maintain the highest possible work standards, however, cannot accept responsibility for any loss, expense or liability of any kind incurred whilst preparing work for The Client in a freelance capacity. To the extent permitted by law, NO HANDS DESIGN shall not be liable to the Client or to any third party for any loss or damage arising directly or indirectly in connection with the provision of services. The Client will indemnify and holds harmless NO HANDS DESIGN from and against any claims, costs, expenses, negligence, actions or suits suffered, sustained or incurred by the Client or any third party. This includes, without limitation, interruptions caused by acts of Nature, or any other circumstances beyond reasonable control, any lost profits, business interruption, loss of data or otherwise, even if expressly advised of the possibility of such damages.
SINGLE POINT OF CONTACT - The Client agrees that all communication will occur through a nominated single point of contact. The nominated person has been identified in advance between The Client and NO HANDS DESIGN.
WORKING FILES - Working files remain the property of NO HANDS DESIGN, unless requested by the client which will incur an additional fee.
PRINTING - NO HANDS DESIGN does not include the cost of printing within the design quote. Printing is quoted separately at time of ordering based on current market prices. All print invoices must be paid upfront and in full before the print order is processed. NO HANDS DESIGN will not be held liable for printing products that are damaged, lost or delayed when delivered by post or courier.
PROMOTION - NO HANDS DESIGN reserve the right to use any artwork or printing we produce for the purposes of promoting our services unless you request otherwise in writing.
HANDOVER - WEB - At the conclusion of a web project, The Client will be provided with a 'Website Delivery' document that details basic information about their website setup and logins. The Client will be provided with a limited-access user login for making additions or changes to their website content. This is to protect against security threats and potential damage to the website design and functionality that can easily be made in error with an Administrative login. Should the Client wish to have full administrative access, a request should be made to NO HANDS DESIGN. The Client will be supplied with one complimentary training session will be provided with a document outlining basic usage. Additional or advanced training sessions will be charged at an hourly rate and can be requested at any time.
The Client agrees that, following the handover of Administrative access, any updated plugins, core files, themes or changes to plugin settings, DNS or any other system that was setup as a part of the website may cause breakages to the front end and/or functionality of the website. As such, NO HANDS DESIGN reserves the right to quote for any work involved in repairing breakages and bugs caused by updates or changes to settings made by the Client.
As browser and CMS versions are updated, Websites need to also be updated to ensure full functionality, security and consistent visual appearance. NO HANDS DESIGN reserves the right to quote for any necessary updates at the Client's request. NO HANDS DESIGN may reach out to the Client to notify them if NO HANDS DESIGN believes the Client is in need of necessary updates based on major releases to plugins, themes, core files or browsers.
WEBSITE SUPPORT - Upon completion of your website, you have 30 days of support included as a complimentary service. Support includes answering questions regarding usage of your site or existing bug fixes. It does not cover content changes, additions or feature requests. Content changes, additions or feature requests will be quoted upon request or charged at the hourly rate.
CANCELLATION / TERMINATION OF AGREEMENT – Should The Client wish to cancel/terminate the agreement and discontinue any work in progress, The Client must notify NO HANDS DESIGN immediately of this intention. The deposit is non-refundable, and any additional Hours worked to that point will be invoiced. In the case of cancellation/termination, outstanding invoices are required to be paid within 7 (seven) days of the invoice issue date. Ongoing work must be cancelled with at least 2 weeks notice. Ongoing work with a minimum term (such as Digital Marketing & SEO) cannot be cancelled before the minimum term has passed. The minimum term will be clearly outlined in the Quote.
VARIATION IN TERMS – These terms can only be varied, amended or altered by NO HANDS DESIGN at any time.
